5.11.\u00a0Newsletter,\u00a0Brochure,\u00a0Message\u00a0-Information\u00a0sources,\u00a0concerning\u00a0products\u00a0in the \u201cWOW Tea\u201d site,\u00a0without\u00a0being bound by the information provided.
5.12.\u00a0Payment\u00a0\u2013\u00a0Collection\u00a0or\u00a0recovery\u00a0of\u00a0funds,\u00a0resulting\u00a0from the\u00a0sale\u00a0of a product.
5.13.\u00a0Force Majeure\u00a0circumstance\u00a0\u2013\u00a0Unforeseeable event,\u00a0beyond\u00a0the control\u00a0of\u00a0the parties,\u00a0which\u00a0cannot to\u00a0be\u00a0avoided.<\/p>

GENERAL<\/strong><\/p>

6.\u00a0The general terms and\u00a0conditions\u00a0set\u00a0out rules,\u00a0by which the\u00a0Customer\u00a0can\u00a0use\u00a0the site\u00a0and\u00a0its\u00a0content, in\u00a0cases\u00a0where there is no\u00a0available\u00a0otherwise\u00a0valid\u00a0agreement\u00a0between\u00a0him\u00a0and\u00a0the Seller.
7.\u00a0The general\u00a0terms\u00a0and\u00a0conditions\u00a0are\u00a0obligatory\u00a0for\u00a0all\u00a0customers\u00a0of the\u00a0site.\u00a0Using\u00a0it\u00a0means the customer has\u00a0introduced\u00a0themselves with them carefully\u00a0and has agreed\u00a0to them\u00a0in\u00a0each\u00a0of his\u00a0use.

The data and personal information provided by users\/customers is used by WOW TEA to manage orders, to deliver products and services, to process payments, to communicate via Email, SMS, Viber, WhatsApp, Social media platforms (Facebook, Instagram, TikTok) with users\/customers regarding orders, products, services and promotional offers or product recommendations.
8.\u00a0Terms and\u00a0conditions\u00a0can\u00a0be\u00a0changed\u00a0unilaterally\u00a0and\u00a0at\u00a0any\u00a0time\u00a0by \u201cWOW Tea\u201d. These\u00a0changes\u00a0come\u00a0into\u00a0force\u00a0immediately\u00a0after\u00a0being published on\u00a0the site.
9.\u00a0With the acceptance\u00a0of\u00a0these\u00a0Terms and\u00a0conditions, the Customer expressly agrees to the conclusion of distance contracts as a result of an Order made by him.
10.\u00a0\u201cWOW Tea\u201d\u00a0reserves\u00a0the right\u00a0to\u00a0terminate\u00a0or\u00a0refuse\u00a0registration\u00a0of the\u00a0customer,\u00a0unilaterally\u00a0at\u00a0its\u00a0discretion,\u00a0without owing any penalty or compensations about it.
11. Placing an order is possible and valid only for the territory of Norway and only for persons over 18 years of age. By registering on the website and creating an order, the Customer declares that he \/ she is of legal age (at the age of 18).
12.\u00a0\u201cWOW Tea\u201d\u00a0specifies\u00a0that\u00a0image\u00a0(static\/dynamic\u00a0presentations\u00a0and\u00a0so on)\u00a0of\u00a0the products\u00a0have\u00a0informative\u00a0character\u00a0and\u00a0is possible that the supplied\u00a0products\u00a0may differ from what is depicted,\u00a0due to\u00a0technical\u00a0errors,\u00a0change\u00a0of\u00a0characteristics,\u00a0design\u00a0or\u00a0their audit.\u00a0The Seller\u00a0does not\u00a0bear\u00a0responsibility\u00a0for\u00a0such\u00a0discrepancies.
13.\u00a0The features,\u00a0descriptions\u00a0and\u00a0prices\u00a0of\u00a0products\u00a0on\u00a0the site\u00a0can\u00a0contain\u00a0errors\u00a0and\u00a0can\u00a0be\u00a0changed\u00a0at\u00a0any\u00a0time.\u00a0The Seller\u00a0does not\u00a0bear\u00a0responsibility\u00a0for\u00a0such\u00a0discrepancies,\u00a0but\u00a0is\u00a0obliged\u00a0to remove them\u00a0in a timely manner,\u00a0if\u00a0such\u00a0are indicated by\u00a0the Customer.
14.\u00a0\u201cWOW Tea\u201d\u00a0reserves\u00a0the right\u00a0to\u00a0make\u00a0changes\u00a0on\u00a0the site,\u00a0its\u00a0structure\u00a0and\u00a0functions\u00a0without\u00a0prior\u00a0notice\u00a0to\u00a0customers.
15.\u00a0\u201cWOW Tea\u201d\u00a0is not\u00a0responsible\u00a0for\u00a0any\u00a0errors,\u00a0which\u00a0can appear\u00a0on\u00a0the site,\u00a0due to\u00a0technical\u00a0reasons.
16.\u00a0\u201cWOW Tea\u201d\u00a0reserves\u00a0the right\u00a0to\u00a0publish\u00a0advertising\u00a0boxes\/banners\/of\u00a0any\u00a0kind\u00a0and\/or\u00a0connections\/links,\u00a0in any part of\u00a0the site,\u00a0according to\u00a0current\u00a0legislation.
17.\u00a0All\u00a0goods,\u00a0including\u00a0those\u00a0in\u00a0promotion,\u00a0are\u00a0sold\u00a0and\u00a0shipped\u00a0to the\u00a0depletion\u00a0of\u00a0the available\u00a0quantities\u00a0from\u00a0the warehouse\u00a0of\u00a0the Seller,\u00a0even if\u00a0that is not\u00a0expressly\u00a0noted\u00a0on\u00a0the site.
18.\u00a0It\u00a0is\u00a0possible that the site\u00a0may\u00a0contain\u00a0links\/referrals\u00a0to\u00a0other\u00a0sites, \u201cWOW Tea\u201d\u00a0does not\u00a0bear the\u00a0responsibility\u00a0for\u00a0the content\u00a0and\u00a0policies\u00a0of\u00a0these\u00a0sites.
19.\u00a0The Seller\u00a0and\u00a0the Customer agree\u00a0that\u00a0all electronic\u00a0communication\u00a0between\u00a0them, including using\u00a0a\u00a0particular\u00a0account,\u00a0has\u00a0the power\u00a0of\u00a0a handwritten\u00a0signature\u00a0in the relations\u00a0between\u00a0them.
20.\u00a0If\u00a0any\u00a0of\u00a0the provisions\u00a0of\u00a0these\u00a0general\u00a0conditions\u00a0for\u00a0use\u00a0of\u00a0the site\u00a0is\u00a0invalid\u00a0or\u00a0inapplicable\u00a0to the\u00a0particular\u00a0contract,\u00a0regardless\u00a0of\u00a0the reason\u00a0for\u00a0this,\u00a0this does not imply any invalidity or inapplicability of the other regulations.<\/p>

SALES CONTRACT<\/strong><\/p>

21.\u00a0The contract for a distance sale of goods\u00a0is\u00a0considered\u00a0to\u00a0be concluded\u00a0from\u00a0the moment\u00a0an order sent by the Customer is accepted by the Seller.
22.\u00a0The Seller informs\u00a0the Customer\u00a0by\u00a0email\u00a0and\/or\u00a0telephone\u00a0for\u00a0the registration\u00a0of\u00a0the contract.
23.\u00a0In\u00a0all\u00a0cases, in\u00a0which\u00a0an order\u00a0is\u00a0registered\u00a0and\u00a0the Customer\u00a0has\u00a0received\u00a0confirmation,\u00a0the same owes payment\u00a0in\u00a0full\u00a0size,\u00a0which\u00a0is\u00a0negotiated\u00a0for\u00a0each\u00a0individual\u00a0order.
24.\u00a0The Seller\u00a0reserves\u00a0the right\u00a0at\u00a0the inability\u00a0to supply\u00a0to\u00a0refuse\u00a0partially\u00a0or\u00a0entirely\u00a0to fulfil the contract;\u00a0as\u00a0in\u00a0this\u00a0case\u00a0he is due to\u00a0return\u00a0only the received\u00a0amounts,\u00a0without\u00a0the charges\u00a0for\u00a0the Customer.
25.\u00a0When\u00a0the warehouse\u00a0stock\u00a0of\u00a0a particular\u00a0item\u00a0is\u00a0insufficient\u00a0for the\u00a0execution\u00a0of\u00a0all\u00a0received\u00a0orders,\u00a0the rule\u00a0in\u00a0the previous\u00a0point is applied.
26.\u00a0Provided\u00a0information\u00a0from\u00a0the Customer,\u00a0as\u00a0well as the\u00a0current\u00a0general\u00a0conditions\u00a0are\u00a0an integral\u00a0part\u00a0of\u00a0the Distance selling contract.<\/p>

INTERNET SALES POLICY<\/strong><\/p>

27.\u00a0Access\u00a0to\u00a0the site\u00a0for\u00a0registration\u00a0of\u00a0an account\u00a0and\u00a0creation\u00a0of\u00a0an order\u00a0is\u00a0allowed\u00a0for\u00a0each\u00a0Customer.\u00a0The Customer bears\u00a0responsibility\u00a0for\u00a0the correctness\u00a0of\u00a0submitted\u00a0data\u00a0and\u00a0for\u00a0compliance\u00a0with the special\u00a0requirements\u00a0of\u00a0the law\u00a0in\u00a0connection\u00a0with\u00a0the conclusion\u00a0of\u00a0civil\u00a0contracts.
28.\u00a0\u201cWOW Tea\u201d\u00a0can\u00a0restrict\u00a0access\u00a0to\u00a0orders,\u00a0products,\u00a0services,\u00a0payment\u00a0methods\u00a0and\u00a0other\u00a0of\u00a0any Customer,\u00a0in\u00a0its\u00a0sole discretion\u00a0without\u00a0prior\u00a0warning\u00a0or\u00a0notice.\u00a0\u201cWOW Tea\u201d\u00a0does not\u00a0bear\u00a0responsibility\u00a0for\u00a0any\u00a0loss, which\u00a0the Customer\u00a0suffers\u00a0or\u00a0may\u00a0suffer\u00a0in the\u00a0result\u00a0of\u00a0this\u00a0decision.
29.\u00a0Each\u00a0Customer\u00a0can\u00a0have\u00a0only\u00a0one\u00a0account\u00a0on\u00a0the site.\u00a0It is not\u00a0allowed\u00a0one\u00a0account\u00a0to\u00a0be\u00a0shared\u00a0between\u00a0several\u00a0Customers; all responsibility\u00a0for\u00a0the\u00a0damages\u00a0from\u00a0such\u00a0sharing\u00a0is\u00a0borne by\u00a0the Customer.
30. All prices on the site are announced in Norwegian krone (Kr) with included VAT.
31.\u00a0The price\u00a0of the\u00a0product\u00a0does not\u00a0include\u00a0the cost\u00a0of\u00a0delivery\u00a0and\u00a0outstanding\u00a0fees\u00a0in\u00a0payment.\u00a0In all\u00a0cases\u00a0before\u00a0the completion\u00a0of\u00a0the contract\u00a0\u201cWOW Tea\u201d\u00a0will\u00a0designate\u00a0a\u00a0site\u00a0value\u00a0of\u00a0the additional\u00a0costs,\u00a0which\u00a0the Customer has\u00a0to\u00a0pay.
32.\u00a0It is possible, after\u00a0the purchase\u00a0of\u00a0goods,\u00a0\u201cWOW Tea\u201d\u00a0to\u00a0ask\u00a0the Customer via e-mail,\u00a0telephone or other means of communication for a review\u00a0of purchased\u00a0goods.\u00a0By voluntarily providing a Review and\/or a photo from the Customer, the same expressly agrees that \u201cWOW Tea\u201d\u00a0can use this Review and\/or photo for advertising purposes on its site or its sub domains.
33.\u00a0Prices\u00a0on\u00a0the site,\u00a0crossed\u00a0with a\u00a0line,\u00a0indicate\u00a0the old\u00a0price\u00a0of\u00a0goods\u00a0in\u00a0the store.\u00a0These\u00a0prices\u00a0are\u00a0informative\u00a0in nature\u00a0and\u00a0have no\u00a0relation\u00a0to the\u00a0actual\u00a0due\u00a0price.
34.\u00a0Upon\u00a0presentation\u00a0of\u00a0products\u00a0and\u00a0services\u00a0\u201cWOW Tea\u201d\u00a0reserves\u00a0the right\u00a0to\u00a0use other\u00a0products\u00a0(accessories\u00a0and\u00a0others),\u00a0which\u00a0may\u00a0be\u00a0not\u00a0be\u00a0included\u00a0in\u00a0the price\u00a0of\u00a0the product.\u00a0In\u00a0such\u00a0cases,\u00a0the description\u00a0of\u00a0the product\u00a0contains\u00a0the included\u00a0set of\u00a0products\u00a0and\u00a0any\u00a0which are not included\u00a0in\u00a0the same\u00a0description\u00a0are\u00a0considered\u00a0to not be\u00a0included\u00a0in\u00a0the kit.
35.\u00a0\u201cWOW Tea\u201d reserves\u00a0the right\u00a0to\u00a0change\u00a0prices\u00a0of\u00a0goods\u00a0and\u00a0services\u00a0at\u00a0any\u00a0time,\u00a0without\u00a0advance\u00a0notification to\u00a0the\u00a0Customer.
36.\u00a0The price of\u00a0products\u00a0and\u00a0services\u00a0is\u00a0this,\u00a0which\u00a0is\u00a0available\u00a0at\u00a0the time\u00a0of\u00a0placing an order in\u00a0the context\u00a0of\u00a0inventory\u00a0balances\u00a0and\/or\u00a0for\u00a0the period\u00a0of\u00a0the promotion,\u00a0if\u00a0there is\u00a0one.\u00a0Any\u00a0changes\u00a0in\u00a0prices,\u00a0occurred\u00a0after\u00a0the adoption\u00a0of the\u00a0order,\u00a0are not\u00a0pertaining to\u00a0it.
37.\u00a0\u201cWOW Tea\u201d\u00a0does not\u00a0guarantee\u00a0availability\u00a0of\u00a0any\u00a0product,\u00a0which\u00a0can\u00a0be\u00a0purchased\u00a0on the\u00a0site,\u00a0before\u00a0it has\u00a0confirmed to\u00a0the Customer\u00a0via email\u00a0or\u00a0phone,\u00a0that\u00a0the contract\u00a0is\u00a0executed\u00a0and an order is\u00a0transmitted\u00a0for\u00a0delivery.
38.WOW Tea may, at its discretion, issue promotional discount codes to individual users \/ customers. The value, scope and period of validity are determined unilaterally by WOW TEA. The promotional codes provided cannot be shared with other users \/ customers.
38.1. Two (2) or more promotions can not be applied to one order.
38.2.Condition for the promotion \u201cfree tea for second order\u201d \u2013 in the order must be selected at least one (1) item at a regular price in addition to the desired free tea.
38.3.Promo codes are not valid for discounted products during a promotional campaign or another type of discounts.<\/p>

ORDER<\/strong><\/p>

39. The Customer can place an order on the site by the addition of the proposed goods and services in the shopping cart, following instructions and steps in the site, in order to complete and sent the order.
40.\u00a0Upon completion of its order, the Customer agrees that all provided information required in the purchase process is correct and complete at the time of the order.
41.\u00a0Incomplete\u00a0orders\u00a0do not\u00a0lead\u00a0to\u00a0registration\u00a0of an\u00a0order.
42.\u00a0Goods\u00a0and\u00a0services\u00a0are\u00a0available\u00a0in\u00a0the context\u00a0of\u00a0produce stock availability\u00a0and\u00a0can\u00a0be\u00a0confirmed\u00a0or\u00a0refused depending\u00a0on\u00a0availability.
43. \u201cWOW Tea\u201d\u00a0reserves\u00a0the right\u00a0to clarify availability\u00a0and\u00a0terms\u00a0of\u00a0delivery by\u00a0phone\u00a0or\u00a0email\u00a0at\u00a0the time\u00a0of\u00a0processing\u00a0of\u00a0an order.
44. \u201cWOW Tea\u201d\u00a0does not\u00a0bear\u00a0responsibility\u00a0for\u00a0compliance\u00a0of\u00a0the terms\u00a0of\u00a0delivery\u00a0of\u00a0the products.
45. Until delivery, the Seller may refuse to partially and\/or fully fulfil a placed order when delivery is impossible because of objective reasons, or due to legal defects in the contract concluded, given they will notify the Customer in advance. In such cases the Seller is obliged to reimburse the amounts paid by the Customer, if any, without this resulting in any additional costs for the same, after which the contract is considered terminated and the parties have no other obligations to each other.
46.\u00a0With the placement of\u00a0an order\u00a0the Customer\u00a0gives\u00a0the right\u00a0to the\u00a0Seller\u00a0to\u00a0get in touch\u00a0with\u00a0them for guidance in\u00a0every\u00a0possible\u00a0way,\u00a0when\u00a0this\u00a0is\u00a0required\u00a0in\u00a0connection\u00a0with the\u00a0said order.
47.\u00a0In\u00a0case \u0430\u00a0change\u00a0in\u00a0terms\u00a0of\u00a0supply\u00a0or\u00a0in\u00a0the contents\u00a0of\u00a0placed order\u00a0or\u00a0in\u00a0other\u00a0terms\u00a0in\u00a0the contract is necessary,\u00a0an employee\u00a0of\u00a0\u201cWOW Tea\u201d\u00a0has to inform the\u00a0Customer via phone\u00a0or\u00a0email.\u00a0In\u00a0such case\u00a0the Customer has the\u00a0right\u00a0to\u00a0refuse the contract\u00a0or\u00a0to\u00a0confirm\u00a0the order.\u00a0In\u00a0both\u00a0cases the\u00a0Seller shall\u00a0not\u00a0be\u00a0liable\u00a0for\u00a0damages\u00a0beyond the\u00a0liability\u00a0for\u00a0repayment\u00a0of\u00a0the\u00a0amounts\u00a0already paid.
48. The Customer can refuse an order up to the moment of receiving information that the order is completed and has a pending shipment. This can be done by emailing address: customers@wowtea.eu.\u00a0In\u00a0these\u00a0cases the\u00a0Seller\u00a0recovers\u00a0fully the\u00a0payment made by the Customer,\u00a0if\u00a0there is such,\u00a0in\u00a0the same\u00a0way that the payment was made,\u00a0without any\u00a0cost\u00a0to\u00a0the customer.\u00a0The Customer\u00a0does not\u00a0bear\u00a0responsibility\u00a0for\u00a0damages\u00a0and\u00a0loss of\u00a0benefits\u00a0and\u00a0the contract\u00a0is\u00a0deemed\u00a0to be\u00a0terminated.<\/p>

RETURN OF GOODS AND WITHDRAWAL OF THE DISTANCE SALES CONTRACT<\/strong><\/p>

49.\u00a0Under the Distance sales contract, any Customer who has the quality of an User may return the product in a non-infringing commercial manner without specifying objective reason for claim within 14 calendar days from the date of receipt of the goods. Return shipping costs are a liability and responsibility of the Customer. \u201cWOW Tea\u201d will not accept goods shipped via cash on delivery payment method.
50.\u00a0Other\u00a0grounds\u00a0for\u00a0termination\u00a0of\u00a0the Distance sales contract\u00a0by\u00a0the Customer\u00a0are:
50.\u00a01.\u00a0Defective packaging \u2013 The Customer may request a replacement of the goods if they find that it is in poor commercial appearance. In this case, the cost of returning the product shall be borne by the Seller. If upon receipt of the goods by the Customer and within 24 hours, the Customer does not contact \u201cWOW Tea\u201d in writing or by telephone to establish the damage to the products concerned, they are considered to have been received in good commercial form. In this case \u201cWOW Tea\u201d is not obliged to replace the respective products.
50.\u00a02.\u00a0Mixed product on delivery. If the Customer finds that the product delivered by the courier is different from the one they ordered, they can return it to courier to send them the correct one. Shipping costs are covered by the Seller.
51. The Customer is obliged to inform the Seller of their intention to return the goods purchased or to withdraw from the Distance sales contract by stating their decision unambiguously by written communication via email within the specified time limit. To exercise their right of withdrawal, the Customer must use the\u00a0Right of Withdrawal Form. Failure to comply with the 14-day product return period or if the product is returned without the Customer notifying the Seller, the latter is not obliged to reimburse the amounts paid by the Customer.

The estimated response time is within 24 to 48 hours (excluding weekends).
53. Goods shall be returned to the warehouse of \u201cWOW Tea\u201d: Company: MLV-Fulfillment, c\/o WOW TEA, Address: Am Bocherich 4<\/strong>, 57271 Hilchenbach, Germany, Phone: 004917642755694 for \u201cWOW Tea\u201d with the option to review and examine the status of the products in order to establish the compliance with the terms for return.
54.\u00a0In\u00a0the event\u00a0that\u00a0the Customer\u00a0exercises\u00a0their right\u00a0to\u00a0withdraw from the Distance sales contract,\u00a0\u201cWOW Tea\u201d shall refund the amounts paid in full not later than 14 calendar days from the date on which the item was accepted back into the \u201cWOW Tea\u201d warehouse. The cost of returning the goods is deducted from the amount that the Consumer has paid in accordance with the contract, except in case the Customer has returned the goods on their own account and has informed the supplier.<\/p>

54.1. If the client no longer wishes his order, he\/she has to return the goods on their account to ATOP LLC. The customer then should provide ATOP LLC with a tracking number. When ATOP LLC has made sure the goods are sent back to the warehouse and the package is not harmed, it has the responsibility to refund the money to the client in 14 calendar days.<\/p>

55.\u00a0The Seller\u00a0has the\u00a0right\u00a0to\u00a0delay the\u00a0recovery\u00a0of\u00a0the amount\u00a0until\u00a0the receipt\u00a0of\u00a0the sold\u00a0goods\u00a0and is not responsible for items which are not delivered to his warehouse.
56. The recovery of the sum is carried out by bank transfer to the account referred to in the Return form which can be downloaded HERE<\/a><\/strong>. If the payment is made by bank card or PayPal, the amount in returned to the card or account from which the payment is made.
57. If the Customer exercises their Right of withdrawal from the Distance sales contract, they must deliver the goods back to \u201cWOW Tea\u201d without undue delay and no later than 14 days from the date the user announces their decision to withdraw from the contract. The deadline is considered to be met if the user submits information for their decision to \u201cWOW Tea\u201d in writing before the expiry of the 14-day time limit.
58.The replacement period, due to a technical malfunction or breakage, of glass bottles and infusers is 15 calendar days from the day of acceptance of the goods by the Customer. The customer is obligated to provide evidence (photo or video) of the technical malfunction or breakage they reported. After this period, \u201cWOW Tea\u201d has the right to refuse the return or replacement of these products.. WOW TEA bottles and limited cups are NOT dishwasher safe. ATOP Ltd. Is not responsible for damage to products after washing in a dishwasher.
59.\u00a0When exercising the Right of withdrawal from the Distance sales contract, the Customer is obliged to keep the goods received from the supplier, their quality intact and in safety upto their return.
60. In case the goods ordered and pre-paid by the Customer cannot be delivered by the Seller, the latter will inform the Customer about this and refund the amount paid within 14 days from the date on which the Seller ascertains this fact or from the date on which the Customer expresses their wish to terminate the contract.
61.\u00a0Conditions\u00a0for\u00a0return\u00a0or\u00a0exchange:
61. 1.\u00a0The Customer must notify the Seller in writing by email with a completed return form. In case of a problem with the products, the customer must provide photos or video material.
61.\u00a02.\u00a0All\u00a0goods\u00a0have\u00a0to\u00a0be\u00a0in\u00a0the same\u00a0condition\u00a0as\u00a0when delivered,\u00a0without\u00a0damages, in\u00a0impeccable\u00a0commercial\u00a0appearance and\u00a0full\u00a0kit.\u00a0The packaging\u00a0should\u00a0be\u00a0intact,\u00a0not broken,\u00a0scratched\u00a0or\u00a0damaged;
61.\u00a03.\u00a0If\u00a0the product\u00a0has\u00a0been\u00a0accompanied\u00a0with\u00a0a gift,\u00a0the same should be returned;<\/p>

61.4. Under the Distance sales contract, any Customer who has the quality of a User may return the product in a non-infringing commercial manner without specifying objective reason for claim within 14 calendar days from the date of receipt of the goods. Return shipping costs are a liability and responsibility of the Customer. ATOP LLC will not accept goods shipped via cash on delivery payment method.<\/p>

61.5. If the client wants to return product which was bought as part of a PROMO bundle \u2013 the regular price of the remaining products (or bundle price, if there is an active promo bundle with the same products) will be charged to the customer (delivery charge will also be added if the order price is less than the required minimum for free shipping). The difference in the amount paid by the customer and the amended order price will be refunded up to 14 days after the customer returns the product.<\/p>

62. If the product is returned in an open\/used state and cannot be sold as new, the Seller reserves the right to refuse the return of the amount paid by the Customer upon the placement of the order, as well as the subsequent costs of the return of the product.<\/p>

PAYMENT<\/strong><\/p>

63.\u00a0Prices\u00a0of\u00a0goods\u00a0and\u00a0services\u00a0are\u00a0final\u00a0and\u00a0include\u00a0VAT,\u00a0as\u00a0well as all\u00a0other\u00a0taxes\u00a0and\u00a0fees,\u00a0provided for\u00a0in\u00a0the current\u00a0legislation.
64.\u00a0Price\u00a0and\u00a0method\u00a0of\u00a0payment\u00a0are\u00a0indicated\u00a0in\u00a0each\u00a0order.
65. Methods of\u00a0payment,\u00a0offered by \u201cWOW Tea\u201d\u00a0are:\u00a0cash\u00a0on delivery,\u00a0money\u00a0transfer\u00a0through\u00a0PayPal, Credit\/Debit Card
66.\u00a0The Customer\u00a0agrees\u00a0to\u00a0perform\u00a0payment\u00a0in accordance with the selected\u00a0by\u00a0them method and the terms of the Distance sale contract upon its\u00a0conclusion and\u00a0under\u00a0conditions\u00a0between\u00a0the Customer\u00a0and\u00a0the respective\u00a0provider\u00a0of\u00a0payment\u00a0services.
67.\u00a0The Customer agrees that the Seller has the right to demand and accept an advance payment for the contracts for the purchase and sale of goods and their delivery.
68\u00a0.\u00a0In\u00a0case \u201cWOW Tea\u201d does not receive payment according to the method chosen by the Customer and within the agreed terms before the order is executed, it shall be considered refused by the Customer.<\/p>

SHIPPING<\/strong><\/p>

69. The Seller delivers the online ordered goods through courier company DHL at the address specified by the Customer.ATOP ltd. It is not responsible if the order has the status of \u201cdelivered\u201d to the courier company, and the customer has claims about it. In this case, the customer must fill out an application that he has not received the order and hand it over to ATOP ltd., So that the latter can start an investigation with the courier company.
70.\u00a0The Seller\u00a0carries out\u00a0the delivery\u00a0of\u00a0goods\u00a0only\u00a0on\u00a0the territory\u00a0of Norway.<\/p>

70.1. As ATOP LLC is company established in the EU and shipments are being sent from the territory of the EU, custom taxes could be imposed upon delivery to the client outside of EU. It remains customer’s liability to be informed of the possible charges that could be imposed on customs.<\/p>

71.\u00a0The\u00a0goods sold\u00a0are\u00a0accompanied\u00a0by the\u00a0necessary\u00a0documents\u00a0and\u00a0original\u00a0packaging.
72.\u00a0The time\u00a0of delivery\u00a0is\u00a0between 3 and 6 working days.\u00a0An exception is point 47.<\/p>

72.1. PRIORITY SHIPPING \u2013 The priority shipping guarantees that your order will be processed and fulfilled with priority before the rest of the orders. Such orders will be also processed and fulfilled with priority in case of stock shortage. Those orders are also the first one to be handled to the courier company for delivery. ATOP LLC will not be held responsible if the courier company delayed the order.<\/p>

73.\u00a0Delivery cost is 50 kr incl. VAT.
74.\u00a0Delivery of\u00a0orders for goods\u00a0of\u00a0value\u00a0over\u00a0400 kr (VAT included) is\u00a0free\u00a0for the\u00a0Customer.
75. The details regarding the terms of delivery of the goods are indicative and the Seller is not bound by them to execute the delivery on a specific date. The Customer is not entitled to any compensation in case of delayed delivery.
76.\u00a0Deliveries\u00a0are\u00a0carried out from\u00a0Monday\u00a0to\u00a0Friday\u00a0between\u00a009.00 and 18.00 o\u2019clock\u00a0with\u00a0the exception\u00a0of\u00a0official holidays.\u00a0There may be an exception for settlements with special service schedule.
77.\u00a0On the day of delivery, the Customer receives a SMS and\/or an e-mail from the courier stating that there is a shipment to be received. If the Customer is not found on the agreed upon day and place and there is no other person to accept the shipment for them, the courier leaves a note that the address has been visited along with contact details. The consignment is returned to the courier\u2019s office to be received upon request. If the Customer does not contact the Seller or the courier company the next day, the order is considered cancelled.
78.\u00a0The Customer\u00a0has the\u00a0opportunity\u00a0to\u00a0open\u00a0and\u00a0examine\u00a0the contents\u00a0of\u00a0the shipment\u00a0before\u00a0paying to the courier.
79.\u00a0\u201cWOW Tea\u201d or a courier company representative notifies the Customer by phone or email if unforeseen circumstances prevent the\u00a0timely\u00a0implementation\u00a0of\u00a0the delivery.
80. The Customer agrees that certifying the goods have been received may be executed by a person, for whom, in the circumstances, it may be inferred that they will pass on the information to the Customer \u2013 party to the contract.
81. The Customer must inspect the goods at the time of delivery and its handing over by the Seller or courier, and if there are any inconsistencies with the order, must notify the Seller immediately.
82.\u00a0The risk of loss or damage of the purchased goods passes on to the Customer at the moment when the latter or a third party designated by them, other than the person appointed by \u201cWOW Tea\u201d Courier Company, accepts the goods.<\/p>

TRANSFER OF OWNERSHIP<\/strong><\/p>

83. The ownership of the goods shall be transferred with the delivery of the goods to the Customer, after payment has been made. The delivery of the goods will be certified by the Customer\u2019s signature on the transport document provided by the courier.<\/p>

CONTRACTORS<\/strong><\/p>

84. The Seller has the right to use subcontractors without having to notify or obtain the Customer\u2019s consent. The Seller will be responsible for the actions of these subcontractors.<\/p>

INTELLECTUAL PROPERTY<\/strong><\/p>

85.\u00a0All content, including, but not limited to, images, design, software, data bases, information and any other content published on the site is property of \u201cWOW Tea\u201d or third parties, in which case \u201cWOW Tea\u201d has been authorized to use.
86. All content to which the Customer has accesses, is protected by the law, unless accompanied by written consent to use between \u201cWOW Tea\u201d and the Customer or a third party.
87. The Distance sale contract does not authorize the Customer to copy, distribute, provide to third parties or change in any way whatsoever any part of the content of the site, except with the explicit consent of \u201cWOW Tea\u201d.<\/p>

CONFIDENTIALITY<\/strong><\/p>

88. The Customer agrees that by providing their personal data to the Seller, it may be used for any lawful purposes without the Seller having to ask the Customer for their consent to process them\u00a0in\u00a0each\u00a0individual\u00a0case.
89. \u201cWOW Tea\u201d may, without the consent of the Customer, collect other information such as, but not limited to, IP address, operating system, visit time, location from which the site is accessible, name and version of the web browser, and other data provided by the web browser used to access the site.
90. The Customer may refuse the collection\u00a0of\u00a0personal\u00a0information\u00a0and request its deletion, thereby withdrawing their consent to the General Terms and Conditions, without further obligation from each of the parties to the other and\/or without any party being held liable for any harm to the other. Exercising of this right is performed in writing through the means of contacting the Seller
91.\u00a0By providing personal\u00a0data\u00a0to\u00a0the Seller\u00a0such as,\u00a0but\u00a0not\u00a0limited to, email and phone,\u00a0the Customer\u00a0gives\u00a0consent to be contacted by the Seller, as well as third parties who are partners of \u201cWOW Tea\u201d.
92.\u00a0The Customer\u00a0is\u00a0responsible\u00a0for\u00a0the protection\u00a0of\u00a0the confidentiality\u00a0of\u00a0their password\u00a0and\u00a0account\u00a0and is\u00a0responsible\u00a0for\u00a0all\u00a0actions,\u00a0carried out\u00a0by\u00a0their account.<\/p>

PERSONAL DATA<\/strong><\/p>

93. \u201cWOW Tea\u201d collects, processes and stores personal data of individuals, in compliance with the regulatory requirements of Regulation (EU) 2016\/679 of the EU and the Council and of the Law on Personal Data Protection in reference to the activities performed by the company. One part of this personal information is collected in connection with the legal requirements imposed on \u201cWOW Tea\u201d, another part is based on the needs to fulfil the contracts concluded with the Customers, and still other is based on the explicit consent of the subjects of this data for marketing purposes and analysis. More detailed information regarding the protection and use of personal data is contained in the Privacy Policy and The privacy policy of \u201cWOW Tea\u201d, which is an integral part of these General Terms and Conditions.
94. According to the Law on Personal Data Protection, the User has the right to access their own personal data which they have entered, as well as to correct of said personal data.
95. The personal data of the Customer may be provided to the relevant state bodies, on the grounds and within the law, and upon their explicit request.<\/p>

RESPONSIBILITY<\/strong><\/p>

96. The Seller shall not be liable for any damage suffered by the Customer or by third parties as a result of force majeure circumstances or such beyond the control of the Seller.
97. The Seller is not responsible for any physical or mental harm as well as allergic reactions resulting from the use of the products. \u201cWOW Tea\u201d products are not recommended for pregnant women, nursing mothers and children under 18 years of age. The products in the \u201cWOW Tea\u201d store are not a medicine or a substitute for one. If you are hesitant about the effects of any of the ingredient, listed on the package of each product, on your physical or mental condition, we recommend consulting your doctor before using the products.
98. \u201cWOW Tea\u201d is not responsible for the actions of any person who uses the content of the site.
99. \u201cWOW Tea\u201d shall not be liable for any damages, direct, indirect, incidental or other, resulting from the use or inability to use the site or for any errors or omissions in the content that may lead to harm.
100. \u201cWOW Tea\u201d does not guarantee to the Customer the availability of any product, access to the site, account, content, products and services and shall not be liable for any damages to the Customer or third parties, resulting from that.
101. \u201cWOW Tea\u201d offers no guarantee that the goods will meet the Customer\u2019s requirements or expectations.
102. \u201cWOW Tea\u201d shall under no circumstances be liable for any damages, including but not limited, to lost profits, loss of information, interruption of activity resulting from the use, inability to use, or the results of use of the site.
103. In all other cases the Seller\u2019s liability is limited to the value of the goods ordered and paid for by the Customer.<\/p>

ADVERTISEMENT\u00a0<\/strong><\/p>

104.\u00a0Upon\u00a0creation\u00a0of\u00a0an account,\u00a0the\u00a0\u00a0\u00a0\u00a0 Customer\u00a0agrees\u00a0by\u00a0default\u00a0to\u00a0receive\u00a0brochures,\u00a0notices,\u00a0bulletins\u00a0and\u00a0other\u00a0special\u00a0offers\u00a0from\u00a0\u201cWOW Tea\u201d.
105. The Customer may at any time refuse to receive the special offers, brochures and notices: By using the special link contained in each special offer; by using a special section in their account; by calling the Seller\u2019s contact numbers; in writing via email.
106. By accepting these terms, the Customer agrees by default to receive calls, messages and short text messages, carried out with or without human intervention, which are necessary for the execution of the contract.
107. The Customer may at any time refuse to receive messages and short text messages by calling the Seller\u2019s contact numbers or in writing via email.
108. \u201cWOW Tea\u201d reserves the right to remove individual Customer contacts from its database without any further commitments and without further notice.
109. \u201cWOW Tea\u201d does not distribute unsolicited commercial communications within the meaning of the Electronic Commerce Act.
110. Refusal to receive special offers and notices does not constitute a waiver of this contract.<\/p>

FORCE MAJEURE CIRCUMSTANCES<\/strong><\/p>

111. The parties are not responsible for the failure to fulfil their contractual obligations if it is due to force majeure circumstances.
112. If, within 14 days of the occurrence of force majeure circumstances, they cannot be overcome, either party has the right to ask the other to terminate the contract without any party being liable for damages.<\/p>

DISPUTES AND APPLICABLE LAW<\/strong><\/p>

113. This Document has been prepared and will be interpreted in accordance with Bulgarian law and legislation.
